Spain, about to approve a new visa for “Digital Nomads”

NEW VISA TO TELEWORKING IN SPAIN

What is intended to be done is to introduce a new visa and residence and work authorization in Spain. This new regulation will allow people to live and telework in Spain even if they are employers of foreign companies.

Until now, this type of worker had taken advantage of the Non-Profit Residence Authorization.

WHO WILL BE ELIGIBLE TO APPLY AS A “DIGITAL NOMAD”?

Those persons who carry out work or professional activity remotely for companies that are located outside Spain, through the exclusive use of the computer, telematic and telecommunication means and systems, will be able to access this type of authorization and visa.

In addition, those self-employed teleworkers may also work for a company located in Spain as long as the percentage of said work does not exceed 20% of their total professional activity.

Highly qualified professionals who certify:

  • be graduates or postgraduates of universities, vocational training and business schools
  • or who have, where appropriate, a professional experience of at least 3 years.

VISA REQUIREMENTS FOR TELEWORKING IN SPAIN

The requirements that have been established in this draft Law for this new visa and authorization in Spain are the following:

  • The existence of real and continuous activity for at least one year of the company or group of companies with which the worker has labour or professional relationship.
  • Documentation proving that the employment or professional relationship can be carried out remotely.
  • In the event of the existence of an employment relationship, the employment relationship between the worker and the company not located in Spain with whom the relationship has been maintained for at least the last three months must be proven, as well as documentation proving that said company It allows the worker to carry out the work activity remotely.
  • In the event of the existence of a professional relationship, it must be proven that the worker has a commercial relationship with one or more companies not located in Spain for at least the last three months, as well as documentation that proves the terms and conditions in those who are going to carry out their professional activity remotely.
